Terms of Service — Job Dispatch Pro

1. Acceptance of Terms

By accessing or using Job Dispatch Pro ("Service"), operated by Job Dispatch Pro LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Job Dispatch Pro is a cloud-based field service management platform that provides scheduling, dispatching, invoicing, client management, team tracking, and communication tools for home service businesses. The Service is offered on a subscription basis.

3. Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscription & Payment

Access to the Service requires a paid subscription. By subscribing, you authorize us to charge your payment method on a recurring basis. Subscription fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

If payment fails, we will attempt to collect via our dunning process. Continued non-payment may result in account suspension or termination.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Transmit spam, viruses, or harmful code
Attempt to gain unauthorized access to any systems
Reverse engineer, decompile, or disassemble the Service
Resell or redistribute the Service without authorization
Use the Service to send unsolicited SMS or email communications

6. Data Ownership

You retain ownership of all data you upload to the Service ("Your Data"). By using the Service, you grant us a limited license to process Your Data solely to provide the Service. We will not sell, share, or use Your Data for advertising purposes.

7. Intellectual Property

The Service, including its design, features, code, and content, is owned by Job Dispatch Pro LLC and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks, logos, or branding.

8. Termination

Either party may terminate at any time. You may cancel your subscription through your account settings. We may suspend or terminate your account for violation of these Terms or non-payment. Upon termination, your data will be retained for 30 days before permanent deletion.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Job Dispatch Pro LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
